1. About these Terms
These Terms & Conditions (“Terms”) govern your use of buybitcoinwithcash.org (the “Website”) and any order you place with us to buy or sell cryptocurrency (the “Service”). The Service is operated by Noventra LLC (“we”, “us”, “our”). By placing an order, you agree to these Terms, our Privacy Policy, our KYC & AML Policy and our Risk Disclosure.
2. Eligibility
- You must be at least 18 years old and legally able to enter into a contract.
- You must use the Service for yourself, with your own funds, and not on behalf of anyone else unless you tell us and we agree in writing.
- You must not use the Service if doing so is illegal where you live.
3. The Service
We buy and sell Bitcoin (BTC), Tether (USDT) and Ethereum (ETH) directly with customers. We are not a custodian: crypto you buy is sent to a wallet address you provide, and we do not hold crypto on your behalf. We do not provide investment, legal or tax advice.
4. Placing an order
- Orders are placed through the Website's order form or on WhatsApp. An order is accepted only when we confirm it and share payment details with you.
- The minimum order is ₹10,000. We may set maximum limits and may change limits at any time.
- You must give us a correct wallet address and network (for example, TRC-20, ERC-20 or BEP-20 for USDT). You are solely responsible for the address and network you provide.
- We may refuse, delay or cancel any order, including where we cannot verify your identity or payment, or suspect fraud, money laundering or a breach of these Terms.
5. Prices and fees
- Prices follow the live market and move constantly. The rate shown on the Website is indicative. Your rate is fixed when we confirm your order.
- A platform fee of 1.5% applies to every trade. The amount you receive after the fee is confirmed before you pay.
- Your bank, UPI app or wallet may charge its own fees, which you are responsible for.
- If your payment does not arrive within the time we give you, we may re-quote the order at the current rate or cancel it.
6. Payment
- Only pay to the account, UPI ID or agent we give you for that specific order. Payments made to anyone else are at your own risk.
- Pay the exact amount quoted, from an account or source in your own name. Third-party payments may be rejected.
- Share clear proof of payment with your order ID. Crypto is released only after the payment has been received in our account.
- Make one payment per order. Do not combine payments for several orders.
7. Selling crypto to us
- Send only the coin and network we confirm, to the address we give you for that order.
- INR is paid once the transaction has the required number of network confirmations.
- Crypto sent to the wrong address or network, or below the minimum, may not be recoverable.
8. All trades are final — no refunds
Once we have sent crypto to your wallet (or INR to your account, if you are selling), the trade is complete and cannot be cancelled, reversed or refunded. This includes cases where the market price moves after your order, you change your mind, or you gave us a wrong wallet address or network.
We do not refund fees. If we cannot complete an order that we have accepted — for example, we cannot verify your identity or payment, or we decline the order — we will return the amount we actually received to the same account or source it came from, less any charges our bank applies. Returns may require identity verification and may take up to 7 business days.
9. Identity verification
We verify customers' identity as described in our KYC & AML Policy. We may ask for identification at any time and may hold an order until verification is complete. Giving false information is a breach of these Terms and may be reported to the authorities.
10. Prohibited use
You must not use the Service for money laundering, terrorist financing, fraud, scams, gambling, sanctions evasion, purchasing illegal goods or services, or any other unlawful purpose. You must not use stolen funds, another person's account, or funds you obtained from someone who was deceived. We may report suspicious activity to the Financial Intelligence Unit – India (FIU-IND) and other authorities, and may freeze or decline transactions as required by law.
11. Taxes
You are responsible for your own taxes. In India, gains from virtual digital assets are taxed at 30% plus cess, and 1% TDS may apply on transfers under Section 194S of the Income Tax Act. Please consult a chartered accountant for advice.
12. Limitation of liability
To the extent permitted by law, we are not liable for losses caused by market price movements; delays or failures of blockchains, banks, UPI or payment networks; errors in information you provide; or events outside our reasonable control. Our total liability for any order is limited to the amount we actually received from you for that order. Nothing in these Terms limits any liability that cannot be limited under applicable law.
13. Complaints and disputes
If something goes wrong, contact us first at help@buybitcoinwithcash.org with your order ID. Keep your payment receipt for at least 90 days. These Terms are governed by the laws of India, and the courts at New Delhi have jurisdiction, subject to any rights you have under consumer protection law.
14. Changes to these Terms
We may update these Terms from time to time. The version on this page at the time you place an order applies to that order.
